Today’s Update: Camp Lejeune Water Contamination

The legal process surrounding the Camp Lejeune Water Contamination continues to move forward, and we want to provide clients with the latest developments as of March 2026.

Ongoing Claim Reviews

Each month, our legal team meets with your claims review representative at the United States Department of the Navy to discuss the status of pending claims. The Department of the Navy continues to evaluate cases that may qualify under the Elective Option (EO) Settlement Program.

This program applies to specific injuries and illnesses that have been linked to exposure to contaminated water at Camp Lejeune. The conditions currently under review include:

  • Kidney Cancer
  • Liver Cancer
  • Non-Hodgkin’s Lymphoma
  • Leukemias
  • Bladder Cancer
  • Multiple Myeloma
  • Parkinson’s Disease
  • Kidney Disease / End Stage Renal Disease
  • Systemic Sclerosis (Systemic Scleroderma)

These conditions were previously outlined in our April client newsletter and remain part of the ongoing review process.

Important Latency Requirement

The Department of the Navy is applying what is known as a “latency” requirement to all qualifying Elective Option claims. This timing rule is an important factor in determining eligibility.

Under this guideline:

  • The diagnosis or treatment must occur at least two (2) years after the first exposure to contaminated water, and
  • No more than thirty-five (35) years after the last exposure.

This timeline is being used to evaluate whether an illness reasonably falls within the medically recognized window related to the contamination exposure.

Status of a Broader Settlement Plan

As we reported in our October 2025 update, the Department of the Navy appointed two Settlement Masters to help develop a broader global settlement framework for claims that fall outside the Elective Option program.

That settlement structure was expected to be announced by the end of 2025. However, at this time, no official details have been released regarding:

  • The final structure of the settlement program
  • A timeline for implementation
  • Whether the October government shutdown affected the rollout schedule
