The Department of the Navy (DON) focus remains the “de-duplication” of claims to eliminate multiple filings by the same claimant and to eliminate claims that do not meet all threshold requirements such as days of service at Camp Lejeune and non-qualifying illnesses. The total number of remaining claims have been reduced by almost 200,000. DON anticipates total appropriate claims will be less than 300,000.

Unfortunately, the litigation track remains bogged down in motion practice and discovery disputes. Our leadership is pushing back aggressively against the Department of Justice (DOJ) attorneys. The “bellwether” cases selected for trial almost two years ago will most likely not be tried until sometime this summer. As a reminder, bellwether cases are representative case that have been selected by our leadership and the DOJ for a bench trial without jury.
