Questions, Concerns From the Department of Justice “Elective Option” settlement program. 

We continue to have questions from our clients concerning the Department of Justice “Elective Option” settlement program. 

The updated statistics for the program include: 

a) As of this week, over 175,000 claims have been filed with the Department of Navy; 

b) Of that number, 109 total offers have been made to claimants selected by the DOJ/DON under the EO program; 

c) Of those 109 offers, 42 claims have been resolved and paid by the government; 

d) The average payout is $240,000 per claim; 

e) These are the ONLY CASES of the 175,000 plus filed that have been resolved and paid;

f) The EO is under the complete control of the government; and 

g) A claimant can only participate if government selects the claimant for an offer and makes an offer.
